What is a Power of Attorney?

A power of attorney (POA) is a legal document that authorises a named person (the "attorney" or "agent") to act on your behalf in legal, financial, and property matters. The person granting the power is called the "donor" or "principal."

When your document will be used in another country, it must be notarised by an Irish Notary Public — and in most cases, also apostilled by the Department of Foreign Affairs — before it will be accepted by foreign authorities, companies, or courts.

Types of Power of Attorney We Prepare:

General Power of Attorney

Broad authority to manage all financial and legal affairs on your behalf. Used when you are abroad for extended periods.

Specific / Limited Power of Attorney

Authority limited to a specific transaction (e.g., "to complete the purchase of property at [address]"). Most common type for overseas property.

Authorises a representative to act on behalf of a company in overseas matters — signing contracts, representing the company in court, etc.

Enduring Power of Attorney

Spanish Property POA — A Common Request

One of the most frequent reasons Cork clients need a notarised POA is for purchasing or selling property in Spain. Spanish law requires all property transactions to be signed before a Spanish notary — but if you can't be present in Spain, you can grant a trusted person (often your Spanish lawyer) a notarised POA to sign on your behalf.
